| Popis | As well as the use of European Union Structural Funds, during the last decade the issue of subsidies has received a broad attention. Simultaneously some doubts about its effectiveness have been raised. The aim of this paper is - from the perspective of the law - to analyze a pair of "systemic" aspects of the provision of subsidies. The paper is divided in two parts. Firstly it tries to find purpose of subsidies as a tool in law. Secondly, it attempts to generally characterize the current legislation for providing subsidies in the Czech Republic. The paper mainly concludes that the subsidies can be understood as a general legal-economic tool, which probably cannot be completely abandoned. It also concludes that the legislation for providing subsidies does not seem to be entirely sufficient with regard to the ambitious tasks (mainly in connection with use of Structural Funds) it is expected to perform. Recodification therefore may be considered. |
