Popis | A legal text is after all a text that implies the existence of someone who wrote it and someone who will read it. Yet when looked closely at the nature of origin of the texts of legal regulations and the way they are later used in relating legal reality, the simple line between the author/sender, the text itself and the reader/recipient poses numerous questions that touch the very nature of law and the form in which it is communicated to the world. This paper looks into certain theories of the reader in literary and communication theories and asks to what extent can we assume or explore the existence of these concepts when it comes to law. Is the legislator in the same position as an author? Does she address the legal text to a specific reader? Or does the legislator presuppose and create her own reader, that is, is the reader an image of a real reader or is she a construct of the author through the legal text? |
