Description | The aim of this workshop has been to identify the strengths, weaknesses, opportunities and threats regarding the alternative dispute resolution (ADR) in financial services including the distant services and distant services provided or concluded by electronic instruments. While the Financial Arbitrator of the Czech Republic has the jurisdiction in payment services and payments instruments since January 1st 2003, he has the newly created jurisdiction in collective investments and consumer credit which has not had sufficient practical effect yet. The similar ADR has been discussed in unsuccessful legislative process on Mortgage Directive. Cui bono? Many cases may be decided in arbitration procedure - its regulation has been gradually made more restrictive in previous years. Workshop also offered some thoughts on ADR in other fields of financial market and on international comparison. It has been accessible free of charge and organized as a part of the European Union Regulation of Financial Services online project (175798-LLP-1-2010-1-CZ-AJM-MO). |
