Description | This paper concerns the issue of procedural aspects of the convergence of copyright, industrial property rights and unfair competition claims. The author defines the procedural notion “the same cause of the action” and deals with questions of lis pedens and rei iudicatae in intellectual property law disputes. Finally, he critically views the interpretation of the “ground of the action” based on the unique factual grounds. Author suggests that the “ground of the action” should be derived not only from the circumstances of the case, but also from the wording certain legal provision. |
