Description The approval of acting in the name of bodies, before they has acquired legal personality, is a legal instrument which breaks the general rule states it is not possible to represent someone who has no legal capacity. Czech legal system approved this “exception” only by the business corporations. The passed recodificational civil code has changed this concept and allowed acting in the name of non-subject by all legal bodies. The aim of this paper is to build up a descriptive analysis of this instrument in the (new) Civil Code, and thereby to offer some personal comments on the topic.
