Description Contribution deals with principle of two instances in administrative proceeding regarding to efficiency of public administration in organizational conception. Contribution tries to explain that present Czech administration does not allow independent revision of administrative decision in the second instance. Czech constitutional court stated that administrative authorities do not fulfil parameters of independence. This fact is not usually considered as inadmissible, thanks to existence of administrative justice. Administrative courts are not allowed to substitute public administration in whole scale. The more is necessary to allow public administrative authorities to operate in certain standards. Otherwise, it is not possible to prevent undesirable influences in administrative decisions. These influences endanger not only efficiency of public administration but also good governance as a complex of fundamental principles. On the other hand, we can find legal systems which operate with existence of independent administrative tribunals. Contribution deals with comparison of outlined systems.
