| Description | The liability of ISPs with regard to their preventive duty has been refused mainly with regard to the statutory limitation of liability and prohibition of general monitoring of communication. However, a recent case-law suggests that the issue is not one sided and with regard to a specific content and a specific user, it is possible to conclude existence of a general preventive duty. |
