Description | The chapter deals with the Viktor Knapps relation to the Brno school of legal normativism, which was very influential before the Second World War. The proponents of this school was František Weyr and Karl Engliš. The normative theory of law professed Kant's critical method, the idea of a dualism between cognition and volition. This chapter criticizes Knapps opinion that Weyrs theory and his school of legal normativism should be called as Neo- Kantian school. I argue that the Brno normative School of Law represents an autonomous version of normativism. The Kant's critical method plays in this school only a role of methodological instrument. |
