Description The paper examines the immunity defence raised by the state within the recognition and enforcement of investment arbitration award based on BIT. The main argument is that both jurisdictional and enforcement immunities should not be applied by the enforcement court since it collides with international obligations laid down in the NY Convention as well as with the shift of international-law paradigm from sovereignty of state to sovereignty of individual, and the related issue of access to justice.
