Description Czech law compensates for the information asymmetry between corporate agents and principles through the rebuttable presumption, which sets the breach of agents' fiduciary duties. In order to succeed in a proceeding, the agents must prove they act in the company's best interest; if there are doubts about it, they lose the case. This paper aims to analyze the described corporate procedural legal rule setting the rebuttable presumption.
