| Description | This paper deals with the problematics of waiving the requirement of double criminality in cases of surrender of people based on the european arrest warrant for a crime that falls within the scope of one of thirty two criminological cathegories, in which the assessment of double criminality is not required by the framework decision on EAW. The paper points out differences between systems of criminal law of member states, which does not enable optimism regarding mutual trust in the uselessness of review of the double criminality. |
