| Description | In my contribution I want to deal with the conflict between a traditional retrospective con-ception of criminal liability, i.e. the liability that follows only after a deed is committed, and a need of ensuring preventive measures efficient enough to prevent serious criminality and its consequences. This contribution thus aims to analyze current requirements on fulfilment of the preventive function of criminal law in the cases of severe criminality even at the cost of interventions into the fundamental rights and freedoms of an individual. |
