| Description | The author deals with impacts of principle of collective criminal liability on current form of evidence in criminal proceedings. Its form was shaped for a long time on the basis of principle of individual criminal liability and liability for guilt. One of the questions that the author deals with is whether the current form of evidence of criminal liability of legal entities is partly build on objective liability or not. The next part of this work contains, among the others, author’s remarks on possibility of using higher court’s outcomes of decision-making process containing judging of evidence during the judging of evidence by law enforcement authorities in other cases.
