Description | The ultima ratio principle is often mentioned when dealing with economic criminality and is often appealed to in these consequences. This very specific kind of criminality lies on the fragile and nebulous border dividing criminal law and solely civil business relations. On one hand, the freedom of enterprise is an essential condition of our current economic model. On the other hand, economic crimes protect very basal interests of the state and the public as a whole. Striking an optimal balance between these two values is of crutial importance. This paper covers the analysis of the projection of the ultima ratio principle into the legal regulation of the economic criminality in the scope of the aformentioned conflict. |
