| Description | In submitted chapter, the author deals with the right of criminally irresponsible children under the age of fifteen to defence in form of mandatorily appointed guardian – attorney regarding the fact that proceedings against these persons are of civil nature. After evaluation of legal regulation de lege lata the author focuses on its comparison with the international legal obligations of the Czech Republic in this area and tries to find an optimal solution to the deficiencies of obligatory legal representation of criminally irresponsible children in proceedings about their otherwise criminal acts in accordance with Chapter III of the Act on Juvenile Justice. |
