| Description | This article responds to decisions of courts in the concrete case of premeditative murder from viewpoint of the form its commit: the courts of I. and II. authority passed judgement like undirect perpetrationship, on the other hand the Supreme court like direct perpetrationship. Author of this article prefers undirect perpetrationship. Statement of the Supreme court is controvers to the principle of prohibition of analogie in malam partem in the criminal law and to the subsidiarity of criminal represion. |
