Description | The paper presents a philosophical-legal analysis of antidiscrimination legislation de lege lata in the Czech Republic. The aim of the paper is to point out the relatively conservative approach of lawmakers in the process of creating DNY PRÁVA / DAYS OF LAW 2015 162 and passing an antidiscrimination act. This legal regulation is only a followup to union legal provisions related to the given issue, defining only „traditional“ or „set“ reasons for discrimination such as race, sex, or religion. The author believes that in making new legislation is necessary to take into account also a current social situation which significantly influences the legal sphere in question. The current liberal and democratic concept of the society enables every individual to express their identity in numerous different manners. Various extravagant hairstyles, clothing, tattoos, piercing, and other forms of unconventional shows of human personalities may serve as examples. Although relatively common today, these matters are often the subject of criticism, xenophobia, or even discrimination from the conservative part of society. Thus, it is necessary to design pro future appropriate legal provisions corresponding with the current social reality and explicitly providing every individual with effective protection against any form of discrimination. |
