| Description | The chapter deals with international legal aspects of permanent submersion of a State territory. The focus is given to questions of continuity and succession in case of permanent submersion of State territory. The article evaluates possiblibilites of continued existence of a State which looses its territory, it further evaluates importance of recognition of a State extinction and analyzes position and status of population which would be forced to leave its previous home State territory and settle abroad. The chapter concludes that permanent submersion of State territory creates an unprecedented situation - current international law de lega lata is unable effectively respond to possible and potential scenarion of permanent submersion of State territory. |
