Description Chapter is devoted to the symbolical concept of an animal in modern law from the perspective of the so-called postmodern legal philosophy. It touches on fundamental issues of establishing fundamental rights of animals. This option is problematic due to the symbolic difference between "them and us" from the point of view of the existing concept of law and rights. The aim of this chapter is to rule out this possibility, without radical changes in the overall concept of individual rights. Despite this view the chapter is designed to prevent the industrial exploitation of animals and strengthen their protection. Related is criticism of the existing private law regulation, which is totally inadequate and controversial.
