Description Public procurement law, respectively institute of public procurement, finds its place on the border between public and private law, as evidenced by the disputableness of the judiciary controls, where is pressure to create judicial body sui generis. The issue of administrative punishment and its relation to various branches of law is closely linked with this problem. Authors of this work deals with two crucial problems of public procurement law. The first of them is a novelty in the form of a fee of filing a stimulus to initiate administrative proceedings ex officio. The second one is in nature the persistent complication in the form of administrative punishment in public procurement and its possible interference with the right to self-government.
