Description | This article analyses recent case law of the Court of Justice (CJEU) with particular interest in the current controversial case of logging in Poland‘s Białowieża forest and the following intervention by the commission and the proceedings for interim measure before the CJEU (C-441/17 R). Furthermore, it focuses on the dispute over the planned construction of a nuclear waste storage facility at the Almaraz power plant in Spain and various aspects of the procedure under Article 259 TFEU and the lasting break in diplomatic relations among the Member States. Then the article provides a summary of the Czech Constitutional Court’s decision of 20. 6. 2017, IV. ÚS 1146/16, which, in effect, restricts public access to information held by companies controlled by the State. In this respect, conclusions of the Fish Legal a Shirley case (C-279/12) and the Aarhus Convention Compliance Committee case law are discussed. Moreover, the article provides a brief commentary on recent cases concerning access to information in the EU Pilot procedure (C-562/14 P), registration of the Stop TTIP initiative (T-754/14), accession to the EUSFTA (Avis 2/15) and other topics. |
