Description | The paper deals with the decisions of the European Court of Human Rights reflecting situations of collisions among legal, biological and social paternities from several perspectives. It is aimed especially at decision of ECHR linked to a question of putative fathers. In connection with this topic the paper is focused on current tendencies of ECHR to enhance a legal situation of biological fathers and on a question if the putative paternity could be considered as “a parental status sui generis”. The paper also presents case-law of ECHR with regards to a legal recognition of fathers in specific situations, for example in the cases of surrogacy, transgender and homosexuals. |
