Description | Trans-people is a term that refers to people suffering from a conflict between psychic and physical gender. Reflection of this widespread social perception has become a new civil code in Czech legal society. He deals with the subject matter in two paragraphs of § 29. In accordance with this provision, there is a change in the sex of a person through surgical intervention while simultaneously preventing reproductive organs. On the basis of the provisions of the new Civil Code, a change in the sex of a person can occur only if two conditions are fulfilled: surgical intervention and reproductive organs. Given that the conditioning of human intervention for recognition of gender change is contrary to the European laws and the case law of the European Court of Human Rights, this contribution will focus on the legal regulation of the issue not only in the Civil Code but also in the Act on Specific Health Services. |
