Description Modern arbitration is based on the interaction of the principle of party autonomy and the definition of the role of the courts in terms of intervention towards arbitration. The definition of the role of the court in arbitration is defined in the UNCITRAL Model Law (UNCITRAL Model Law on International Commercial Arbitration 1985, with amendments as adopted in 2006) in its Article 5. The paper analyses this position in the different phases of the arbitration procedure from the point of the Czech law with regard to international and national arbitration.
