| Description | In my article I would like to focus on one of the key guarantees of legality namely the publicity of the main trial for this very guarantee is alfa and omega of the whole criminal process. This article covers both the legal enshrining of this guarantee and emphasizing of the substance and this guarantee’s reason of existence and also its restriction in specific situations including answer the question why this restriction is admissible and approved both in the Act and in the second sentence of the Article 38, paragraph 2 of the Charter of Fundamental Rights and Freedoms. |
