Description | The chapter is dealing with the problem of excessive air pollution in the Czech Republic. It is aimed at the role of EU law in situation when EU Member State does not comply with ambient air quality limit values set for PM10 by Directive 2008/50/EC. At first, applicable national regulatory instruments are investigated to show that source related legislation is closely interconnected with ambient air quality oriented legislation. The EU law requirements are dealt with in relation to infringement procedure against the Czech Republic and to its effort to implement the directive correctly so as to comply with EU law requirements. Finally, the attention is given to the question what legal possibilities do people living in the areas with excessive air pollution by PM10 particulates have to protect the environment they live in, and consequently also to protect their health. |
