Description The Charter of Fundamental Rights and Freedoms as a constitutional law establishes the most important values that every democratic country must respect. One of these values is right to liberty, which is expressed in Article 8 by the words „Personal freedom is guaranteed.“ However, some of these values may be restricted under certain conditions. In addition to the situations referred to in above mentioned Article, right to liberty may also be restricted by imposing a punishment of imprisonment which could be regarded as the greatest interference with this constitutionally guaranteed right. It is necessary to ask the question, where is the limit, when it is inevitable to preserve personal freedom of an individual, and when it is possible to restrict a person to it by the imprisonment. The aim of this contribution is finding an answer to this question.
