| Description | The chapter considers the conditions for the use of testimony of an unavailable witness. Firstly, it sumarises the current legal framework and the human rights requirements arising from the ECtHR case law, shows how the shortcomings of the current legislation are dealt with, and outlines the proposed legal framework that is being discussed. In this context, the chapter assesses the appropriateness of the proposed changes with regard to human rights requirements and discusses some aspects of this issue. |
