Description | Th is article provides a brief commentary on the recent case law of the European Court of Human Rights (ECHR) related to environmental protection or protection of cultural heritage: decisions in cases Ahunbay and Others v. Turkey (6050/06), Pop and Others v. Romania (54494/11, 67699/11 and 21251/12) and Vecbaštika and Others v. Latvia (52499/11). A particular interest is paid to the concept of positive obligations in environmental protection according to Article 8 of the European Convention on Human Right, following a recent judgement of the ECHR in case Hudorovič and others v. Slovenia (24816/14 and 25140/14) which concerns insuffi cient measures to ensure access to drinking water and sanitation for excluded Roma communities. |
