Description | The phenomenon of Muslim veiling in Europe represents, on the one hand, the sovereign drawing of traditionally enshrined freedom of expression of religious belief, and, on the other hand, faces constant attempts to restrict it in various types of public space. The paper will try to qualify this religious symbol in terms of constitutional law and constitutional values shared in the common space of the member states of the Council of Europe. The debate on muslim veiling in Europe is linked to the universalism of women’s and therefore human rights. Does this religious symbol have a different meaning in the western states of the Council of Europe than in traditionally Muslim countries? Does veiling represent female emancipation or, conversely, a manifestation of patriarchal despotism? |
