Description | When interpreting legal norms interpreters use case law and refer toselected parts ofcourt decisions, orspecifically tolegal sentences. This may seem completely unproblematic and even anappropriate means ofensuring legal certainty and, therefore, that the court decision was not unexpected. This might seem tolead oagreater degree ofjustice, where the same orsimilar cases are decided inthe same way. This article will point out that ifthis use ofcase law and legal sentences occurs regardless ofthe context, itmay, onthe contrary, lead toinjustices. This article aims topoint out that context isavery important aspect while interpreting the law, consequently while using case law and legal sentences, which must notbe neglected. |
