Description | The chapter first defines the difference between formal and material equality and considers the reasons why advantage should be given to the less represented sex. It analyses relevant Czech and European legal regulation in order to answer the question whether giving advantage to the less represented sex is legally allowed and under which conditions. Further, the chapter considers possible positive action de lege ferenda and in the end looks for solutions outside the framework of legal regulation. |
