Description | Since 2015, the EU institutions has been working on a reform of Common European Asylum System (CEAS), which is supposed to critically reflect experience with so called migration crisis of 2015–2016. From the human rights perspective, one of the most pressing issues that arose was the extent and material conditions of interferences with personal liberty of asylum seekers or irregular migrants. In 2019, we are still waiting for the legislative package to be approved. Despite the fact it is still work-in-progress, the paper will try to identify main principles of proposed legislation concerning immigration detention, to outline its trends and to assess if it meets requirements from the ECtHR and CJEU recent case law. |
