Description The paper will focus on the out-of-court settlement of consumer disputes arising from the mediation of energy auctions. Consumers are offered free of charge to bid for a more advantageous supplier through distance or door-to-door sales. A dispute arises when a consumer refuses to enter into a contract with a supplier or cancels a contract with a supplier. In such a case, the consumer is penalised by the supplier or intermediary for obstructing the supply of energy with a contractual penalty. The contractual relationship involves the energy intermediary, the supplier and the consumer. The Energy Regulatory Office is the entity for out-of-court dispute resolution in the energy sector, but it does not have jurisdiction over disputes with energy auction intermediaries. The paper aims to answer the question of which entity is competent to resolve disputes and what are the mechanisms for out-of-court resolution of consumer disputes. It also outlines the problematic aspects of the model and proposes solutions.
