Description After the adoption of the new Civil Code, Czech case law must also deal with the interpretation of transitional provisions. An important issue here is the assessment of new legal facts that took place after the adoption of the new law but relate to legal relations that arose during the effectiveness of the old legislation. The article criticizes that the courts do not take into account the fundamental principles on which intertemporal law is based, in particular the principles of protection of confidence in the law. Instead, they mechanically assess almost all new facts that concern old legal relations under the previous legislation.
