| Description | The Czech regulation of notarial deeds with an enforceability clause requires that the enforceability relates to the obligation right. In practice, such notarial deeds sometimes relate to the tenant's obligation to return the leased item upon termination of the lease. The Supreme Court refuses to consider this obligation of the tenant as a contractual obligation, but instead understands it as a way of protecting the landlord's property right. The subject of this article is a critique of this approach. |
