| Description | This written contribution deals with Air Quality Plans as a strategic legal instrument in the field of air protection. The ambition of this contribution is to analyse the regulation regarding Air Quality Plans in current and past air protection legislation with focus on the legal forms of these strategic legal instruments in each respective legislation regarding Air Quality Plans. This written contribution aims to point out some problematic aspects related with the choice of legal form of these strategic legal instruments and their regulation. Concurrently this contribution aims to stress out existing interpretation difficulties and application pitfalls based on relevant EU’s regulation, development of the regulation regarding Air Quality Plans and also relevant case law of Czech courts and Court of Justice of the European Union. |
