| Description | This contribution is focused on the problematic aspects of the legal regulation of the transfer of criminal liability of a legal entity to its legal successors. The authors analyse this provision from the historical, legal and legislative drafting perspective. Czech criminal law, historically based on individual culpability, has known liability of legal entities which has a significantly subsidiary nature, since 2012. The introduction of the transfer of criminal liability in this regulation has, on the other hand, a significantly repressive nature reaching the intensity of overextension of criminal repression. |
