Description | This article provides a brief commentary on the recent case law of the Court of Justice of the European Union (CJEU) related to environmental protection. Following several preliminary questions recently referred to the Court of Justice by Czech administrative and civil courts, the article focuses on the judgments of the Court of Justice in cases C-181/20 (VYSOČINA WIND) and C-524/20 (VÍTKOVICE STEEL). A short analysis is provided by the article on the dispute between the Czech Republic and Poland over mining at the Turów mine in Poland, which has escalated into proceedings for an action by a Member State against another Member State under Article 259 TFEU in Case C-121/21 (Czech Republic v. Poland). |
