| Description | The article considers two doctrinal directions in the case-law of the Czech Constitutional Court in the field of conditional release from prison. In the first part the author analyses the most important decisions (counting now in dozens) and their doctrinal conclusions. Following on that the author defends the argument that there are important contradictions in the case-law and tries to find their cause. Finally the author tries to “extract” the constitutional sources for both persisting doctrines and their incompatibility. The article also identifies problems eraising from this situation and offers some possible solutions. |
