| Description | The article deals with the nature of sublease in Czech law. It criticizes the existing approaches (including the conclusions of court case law) which consider it as a special type of contract similar to a lease. The article is based on the solutions of related legal systems and points out the need for an independent assessment of the relationship between the tenant and the subtenant. |
