Description | The present paper will focus on the influences of COVID-19 in the field of criminal law, or more specifically, in the field of evidence in criminal Vliv COVID-19 na trestní právo 61 proceedings. The introductory part of the paper will be devoted to defining possible problematic aspects of evidence in criminal proceedings caused by the global pandemic. The next parts will be focused on a closer analysis of these issues, not only through the lens of criminal law, but also through the so-called auxiliary sciences of criminal law, especially criminalistics. Attention will be paid, for example, to the interrogation of persons hospitalized in a health care facility, or to the conduct of personal or house searches of persons who were quarantined at the time, either for preventive reasons or because they were actually infected (tested positive). The final part will be devoted to de lege ferenda considerations on what legislative changes could eliminate the problems in the legal regulation of evidence in criminal proceedings, which came to light during the COVID-19 pandemic. |
