Description | In the Czech Republic and the European Union, the issue of safe harbor protection and platform liability for copyright infringement is a complex one. Unfair competition claims are increasingly used in the Czech Republic as a way to supplement copyright protection and possibly extend legal protection. In addition, these claims of unfair competition have important implications for the scope of the public domain. Presentation inspects the structure of two specific unfair competition claims in the cases Hellspy and Codexis and their logic, with a focus on how they are used to supplement and potentially expand copyright protection. Moreover, Husovec’s framework of accountability is applied to observed problem in Hellspy case. |
