Description | The Lisbon Treaty imposed on Member States the duty and the task of ensuring effective judicial protection. This mandate has been transformed during the last few years into a measure of judicial independence and thus into an instrument for solving the EU's rule of law crisis. However, this substantive view is very narrow, neglects the procedural obstacles and is therefore one-sided. This article highlights the formal and informal hurdles in enforcing these newfound standards of judicial independence and emphasises that access to the court - as a part of effective judicial protection - is a precondition for any assessment of judicial independence. |
