Description The justice system is constantly evolving in its relationship with offenders of acts otherwise criminal, from punitive to restorative, from hostile to friendly, or at least it is trying to do so. Thus, there is a certain change in values, which, given the overlap of this issue with the civil law sector, are quite broad. However, despite the noticeable development in the last decade, Czech legislation still struggles to grasp this issue, which is further reflected in the treatment of children in the context of court proceedings. My paper therefore takes a critical approach to the current state of this issue. Specifically, it will deal with the treatment of a child under the age of 15 in the course of quasi-criminal proceedings with child as the perpetrator or the person to be helped. The paper will look at it through the lens of both theory and practice, from the perspective of domestic legislation, and will reflect in particular on the draft amendment that moves the whole procedure toward a truly child-friendly justice.
