Description | This presentation examined the criminal development and impact of the crime of sexual intercourse with a person of the same sex in socialist Czechoslovakia. In particular, this presentation focused on Section 244 under the 1961 Criminal Code. Under this section, people who had homosexual sexual intercourse with persons under the age of 18, in the abuse of dependency, and those who provided and received same-sex intercourse for payment in the form of homosexual prostitution, as well as those who caused public outrage by same-sex intercourse, were prosecuted. The most common perpetrators were people providing homosexual sex – prostitutes. These perpetrators were united by the fact that they were unemployed, often consumed alcoholic beverages, were uneducated and often had previous convictions. Often these offenders also committed other criminal activities. The most common offence was the offence of petty servitude or other property crimes. They had homosexual prostitution as a form of livelihood as well as other criminal activities. |
