| Description | The presented paper attempts to examine whether the judicial review of administrative acts of universities in disciplinary proceedings differs from the judicial review of another administrative acts, punitive or otherwise. It will attempt to identify these differences and critically examine them in the context of the current Czech legislation and case law, as well as the constitutional and international framework of administrative justice. The key issues addressed by the paper are the unclear identification of the respondent in the proceedings before administrative courts, the issue of suspensory effect of the administrative action in disciplinary matters, as well as the right of the court to reduce the administrative sanction and the relation of this right to the autonomous status of universities and faculties as specific public law corporations. The paper will include an overall assessment of the current case law relating to university disciplinary proceedings, including cases involving Masaryk University. |
