Description | Although society has a public interest in nature conservation, there may be circumstances where another public interest outweighs the interest of nature conservation. In such a case, it is necessary to apply the provisions of Section 56 of Act No. 114/1992 Coll., on Nature and Landscape Protection. This provision makes it possible to grant an exemption from the protection of specially protected animals, plants and monumental trees and thus to authorise the implementation of activities and interventions that are a priori prohibited by this Act. The exemption can be issued in three different procedural forms. It can be granted by means of an administrative decision, a measure of a general nature or the conclusion of a subordinate public contract. In this paper, the focus is primarily on the granting of an exemption in the form of an administrative decision. This decision can be defended against through the courts by filing an administrative action pursuant to Article 65 of Act No. 150/2002 Coll., the Administrative Procedure Code, or subsequently by filing a cassation complaint with the Supreme Administrative Court. The aim of this article is to discuss in more detail the issue of judicial review of decisions to grant or not to grant an exemption, with an emphasis on related administrative actions. |
