Description | Assisted reproduction makes it possible to fulfil the desire for one's own offspring for those who, for various reasons, cannot conceive naturally. It is therefore a specific form of help that has both individual and societal benefits. At the same time, however, it is accompanied by the existence of a number of ethical and legal problems. One of these is the fact that donor-conceived children in the Czech Republic and in some other European countries do not have access to the identity of the donor (the genetic parent) or at least to non-identifying information about this person. Attention must therefore be paid to whether this is an impermissible interference with the right to know one's origins as part of the broader category of the right to identity and the right to private life (taking into account the conflicting rights of other persons and public interests), in the light of international obligations and the recent case law of the European Court of Human Rights. |
