| Description | Vladimír Kubeš (1908–1988), a professor of philosophy of law, was forced to leave the Brno Law Faculty for a second time in the early 1970s for political reasons. As he was no longer allowed to publish in Czechoslovakia, he moved abroad to pursue his scientific and teaching activities. For ten semesters he taught at the Faculty of Law in Vienna. When his tenure as a visiting professor ended in June 1981, he was commissioned by the then Federal Chancellor Bruno Kreisky to write a book on the relationship between Hans Kelsen and František Weyr for the Hans Kelsen Institute. Kubeš gladly accepted the offer, as it was a subject close to his heart and he held Weyr in high esteem as his teacher. After a year’s work, Kubeš published his book entitled Hans Kelsen and the Life and Work of Franz Weyr (Several Sketches). Here he compares Weyr's teachings with Kelsen's, explains the main differences between the two concepts, and highlights the personal aspects of the two thinkers. The comparison was clearly in favour of František Weyr, the founder of the Czechoslovak school of the pure theory of law (normative theory). However, due to a lack of financial resources, the book was not published and thus remained only in manuscript form. Now, more than 40 years after it was written, the general public has the opportunity to read this work by Kubeš. |
